Terms of Service

1. Who we are

Descrideo is operated by Lev Svitelskiy (Kyiv, Ukraine) ("Descrideo", "we", "us"). These Terms of Service ("Terms") govern your access to and use of our website, web portal, and related services (the "Service").

By creating an account, purchasing usage tokens, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for users aged 13 and older. If you are under 18, you may use the Service only with the consent of a parent or legal guardian who is responsible for your use.

3. Accounts

• An account is required to access the portal features (videos, jobs, and billing).
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You may request account deletion at any time. Deleting your account may remove access to your job history and stored results.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• Use the Service for unlawful purposes or in violation of applicable laws or regulations
• Upload or process content that infringes intellectual property, privacy, or other rights of others
• Attempt to probe, scan, or test the vulnerability of the Service, bypass security, or interfere with normal operation
• Abuse rate limits, automate excessive requests, or otherwise degrade the Service for others
• Use the Service to distribute malware, spam, or harmful content

5. Your content and rights

You retain all rights to videos and other materials you upload or submit to the Service ("Content").

You grant us a limited, non-exclusive license to process your Content solely to provide the Service (including generating descriptions, titles, tags, and related metadata) and to operate, maintain, and secure the Service.

6. Video processing and storage

• Temporary storage: Uploaded videos are stored in S3-compatible object storage (Cloudflare R2) for processing and are deleted automatically shortly after processing completes.
• Portal results: For portal users, we store generated outputs (e.g., descriptions and job metadata) in our database so you can view your history.
• API results: For API usage, outputs are delivered via webhook and are not stored as a hosted API archive by us.

7. Purchases, payments, and taxes

Paid plans are sold as one-time purchases of usage tokens (credits). Tokens are consumed based on successful job processing and selected options (e.g., audio transcription add-ons).

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Taxes (such as VAT or sales tax) are calculated and collected by Paddle where applicable, and are displayed at checkout.

8. Service availability and disclaimers

We strive to provide a reliable Service, but we do not guarantee uninterrupted or error-free availability. The Service is provided on an "as is" and "as available" basis.

9. Changes to the Service and Terms

We may update the Service, pricing, or these Terms from time to time. For material changes, we will provide notice (for example, by posting an update on this page) at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

10. Suspension and termination

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms or used the Service in a way that could create legal or security risk.

Upon termination, we may delete your account data in accordance with our Privacy Policy and legal obligations.

11. Refunds

Refunds are handled by Paddle and governed by our Refund Policy. Please see our Refund Policy page for full details.

12. Limitation of liability

To the maximum extent permitted by law, Descrideo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

In any event, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid for the Service in the 3 months preceding the event giving rise to the claim.

13. Governing law and disputes

These Terms are governed by the laws of Ukraine. Any disputes will be resolved in the courts located in Kyiv, Ukraine, unless mandatory consumer protection laws provide otherwise.
